  • Limitation of Liability: The service of the one-stop shop system of the Planning Authority of the Historic Center of San Salvador (APLAN) is provided under the following terms and conditions of limitation of liability. APLAN is not responsible for any interruption, error or failure in the service that may arise from causes beyond its direct control, including, but not limited to, failures in the internet connection, problems with the electrical supply, natural disasters, acts of terrorism, or any other circumstance of force majeure.
  • Likewise, APLAN assumes no responsibility for the accuracy, completeness or timeliness of the information provided by users through the one-stop system. It is the sole responsibility of the user to ensure the accuracy and validity of the data entered. Any decision made based on the information provided through this service is the responsibility of the user.
  • APLAN shall also not be liable for any direct, indirect, incidental, consequential or special damages that may arise from the use or inability to use the service, including, but not limited to, loss of data, business interruption or any other economic damages. Use of this service implies acceptance of these limitations of liability by the user.
    • Users are advised to keep backup copies of all relevant information and to verify the receipt and status of their procedures through APLAN’s official channels. The objective of the single window is to facilitate and streamline processes, but always within the framework of shared responsibilities between the Authority and the user.
  • Applicable Laws: These Terms and Conditions, which govern the service and operation of the One-Stop-Shop system of the Planning Authority of the Historic Center of San Salvador (hereinafter, APLAN), are strictly subject to and must be interpreted in accordance with the legal framework in force in the Republic of El Salvador. Specifically, the application of these Terms and Conditions is based on the following regulations:
  • Law of the Planning Authority of the Historic Center of San Salvador (APLAN): This law constitutes the fundamental pillar that governs the existence, attributions, competencies and scope of action of APLAN. All matters concerning procedures, requirements, deadlines and other provisions related to urban planning and development in the Historic Center, which are processed through the One-Stop Shop, shall be governed by the provisions of this law. It includes, but is not limited to, aspects related to licenses, permits, authorizations, zoning procedures and any other management that is the responsibility of the APLAN.
  • Administrative Procedures Law (LPA): The LPA establishes the general framework and principles to be observed in all administrative procedures carried out within the Salvadoran public administration. In the context of the APLAN Single Window, the LPA guarantees due process, transparency, publicity, speed, efficiency and legality in the processing of requests. This implies the application of its provisions regarding:
    • Rights and duties of the administered: Ensuring citizen participation, access to information and the possibility of filing appeals against administrative decisions.
    • Form and validity of administrative acts: Defining the requirements for the issuance of resolutions, agreements and other actions of the APLAN.
    • Deadlines and notifications: Establishing the maximum times for the resolution of procedures and the mechanisms for communicating the proceedings to the interested parties.
    • Administrative appeals: Providing avenues for the administrators to challenge APLAN’s decisions that they consider contrary to their interests or to the legal system.
    • Principles of good faith and legitimate trust: Guiding the actions of the administration and individuals in the development of procedures.

The interaction between the two laws ensures a robust and transparent legal framework for the management of the services offered by the APLAN One-Stop Shop, guaranteeing legal certainty for users and the correct application of the regulations by the Authority. Any interpretation or dispute that may arise in relation to these Terms and Conditions will be resolved in accordance with the provisions of these two fundamental laws.

  • Modifications: The institution reserves the right to modify these Terms and Conditions at any time it deems appropriate and necessary. These modifications may include, among others, changes in the policies of use, in the availability of services, in the applicable rates or in any other provision that governs the relationship between the institution and its users.
  • It is the user’s responsibility to periodically review these Terms and Conditions to be aware of any updates or changes. However, in an effort to proactively keep our users informed, any significant modifications will be notified to users via email. Notification will be sent to the email address the user has provided and has on record in our systems. Users are advised to keep their contact information updated to ensure proper receipt of these communications.
  • Continued use of our services after the publication and notification of any modifications to the Terms and Conditions shall constitute tacit acceptance of such changes by the user. In case of not agreeing with the modifications, the user will have the option to stop using the services offered by the institution.
  • Dispute resolution: The management of any differences or disagreements that may arise will be carried out strictly through the established channels and procedures. In the first place, the channels enabled by El Salvador’s Administrative Procedures Law, a robust legal framework that guarantees transparency, fairness and due process in the resolution of administrative disputes, will be applied. This law provides clear guidance on the steps to be followed, deadlines, available resources and the instances to which any conflict can be addressed.

In addition, and complementing the legal framework, the institution will determine specific internal policies for such purposes. These policies will be designed to address the particular nature of the disputes that may arise, offering agile and efficient mechanisms that allow for a prompt and fair resolution. The objective is to provide an environment where conflicts are handled in a constructive manner, always seeking conciliation and mutual understanding before escalating to higher levels. The combination of legal regulations and internal policies guarantees a comprehensive and adaptable approach to conflict resolution, protecting the rights of all parties involved and maintaining harmony within the institution and in its external interactions.
